# Acme Affiliate Program Terms

These Affiliate Program Terms ("Terms") govern participation in the Acme affiliate program (the "Program") operated by Acme Technologies, Inc. ("Company", "we", "us", or "our") through https://acme.com. By applying to, accessing, or participating in the Program, the participating person or entity ("Affiliate", "you", or "your") agrees to these Terms.

## 1. Enrollment and eligibility

You must provide complete and accurate application, identity, tax, and payment information. We may approve, reject, suspend, or remove an Affiliate when reasonably necessary to protect the Program, enforce these Terms, or comply with law. Approval does not create an employment, agency, franchise, partnership, or joint venture relationship.

## 2. Qualifying referrals

A qualifying referral is a new customer who reaches https://acme.com through an authorized Affiliate link, completes an eligible paid transaction, and is attributed to the Affiliate under these Terms. Transactions that are fraudulent, cancelled, refunded, charged back, duplicated, or otherwise invalid do not qualify.

Existing customers do not qualify unless we approve an exception in writing. Self-referrals are prohibited, including purchases made for your own use or through an entity you control.

## 3. Attribution

We use last-click attribution with a 30-day attribution window. A referral is eligible only when our tracking records associate the customer with the Affiliate within that window. Browser settings, blocked cookies, deleted identifiers, device changes, and incorrectly formatted links may prevent attribution. Our records control when reasonably maintained and applied consistently.

## 4. Commission

The standard commission is 25% of net qualifying revenue for up to 12 months from the customer's first qualifying payment. Commission is calculated on net revenue actually received by us, excluding taxes, credits, discounts, refunds, chargebacks, processing reversals, and any other excluded amounts stated in the applicable offer.

We may publish different rates for particular products, campaigns, or Affiliate groups. The rate displayed in the Affiliate portal or confirmed in writing for the applicable referral controls.

## 5. Validation, refunds, and reversals

Commission may remain pending while we validate the transaction and any applicable refund period. If an underlying transaction is refunded, cancelled, disputed, charged back, fraudulent, or otherwise invalidated, the related commission may be cancelled or reversed. A reversal may be deducted from a future balance where permitted by law.

## 6. Payouts

Eligible balances are reviewed for payout monthly. The minimum payout threshold is $50.00. A valid balance below that threshold carries forward until the threshold is met. Payout timing may depend on verification, banking availability, tax documentation, and the resolution of pending or disputed transactions.

You are responsible for accurate payout details and for taxes, filings, fees, or obligations arising from amounts you receive, except where we are legally required to withhold or report them.

## 7. Promotion rules

- Paid advertising using an Affiliate link is prohibited unless we approve it in writing.
- Bidding on Acme names, trademarks, product names, domains, or confusingly similar terms is prohibited.
- Coupon, deal, loyalty, and cashback sites may not promote the Program without our written approval.
- Unsolicited bulk messages, deceptive redirects, cookie stuffing, adware, forced clicks, hidden frames, fabricated reviews, misleading claims, impersonation, and unlawful promotion are prohibited.
- Affiliate links may not be placed on content that is unlawful, infringing, hateful, sexually exploitative, or otherwise reasonably likely to harm customers or the Company.

## 8. Disclosures and representations

You must clearly and conspicuously disclose your material connection with the Company whenever required by applicable advertising, consumer-protection, endorsement, or platform rules.

You must describe the Company and its products accurately, use only claims you can substantiate, and avoid promises about results or features that we have not authorized.

## 9. Intellectual property

We grant you a limited, revocable, non-exclusive, non-transferable license to use approved Program links and brand materials solely to promote eligible products under these Terms. You may not alter our marks, register confusingly similar names or domains, sublicense the materials, or imply sponsorship beyond Program participation.

## 10. Confidentiality and data

Non-public Program information, customer information, security details, and business information must be protected and used only for Program participation. You must comply with applicable privacy, marketing, and data-protection laws and may not independently collect sensitive customer data through an Affiliate link.

## 11. Suspension and termination

Either party may end participation at any time. We may suspend tracking or payouts while investigating suspected fraud, abuse, breach, or legal risk. On termination, you must stop presenting yourself as an Affiliate and stop using Program materials. Validated commission earned before termination remains subject to these Terms, including refund and reversal rules.

## 12. Disclaimers and liability

The Program is provided on an "as available" basis. We do not guarantee traffic, conversion, commission, uninterrupted tracking, or continued availability of any offer. To the extent permitted by law, neither party is liable to the other for indirect, incidental, special, exemplary, or consequential damages arising from the Program.

## 13. Changes

We may update the Program, commission rates, eligible products, or these Terms. Material changes apply prospectively after notice through the Affiliate portal, email, or the Program website, except when an immediate change is reasonably required for security, fraud prevention, or legal compliance. Continued participation after an update takes effect constitutes acceptance where permitted by law.

## 14. Governing law and contact
